Case has a real kick

bporterfield@pvdemocrat.com — It was unusual to be sure as criminal charges related to some good old fashioned moonshine have hit the books here in Garvin County.

Filed Wednesday in Garvin County District Court were a couple of counts coming from what a state trooper found last month during a traffic stop near Wynnewood.

Found in the vehicle’s back seat were a number of jars filled with a liquid described as apple pie flavored moonshine.

The first charge filed against Jon Brooke, 51, of Cement was a felony count for failing to pay a liquor excise tax on more than 1 liter of alcohol.

A misdemeanor charge of violating the Oklahoma Beverage Act was also filed against Brooke.

The two formal charges stem from the evening of March 22 when a vehicle driven by Kenneth Mullendore, 48, of Wynnewood was stopped for speeding.

Riding in the vehicle as a passenger was Brooke.

The stop came about 6 miles west of Wynnewood as the vehicle was traveling on state Highway 29.

Making the traffic stop was Oklahoma Highway Patrol Trooper Chase Miller.

The trooper reported it was immediately apparent Brooke was heavily intoxicated with a slurred speech that could barely be understood, while he was also unsteady on his feet.

When the trooper inventoried the vehicle’s contents he found eight quart size Mason jars in an ice chest placed in the back seat.

Inside the jars was a liquid described as “incredibly” strong with an odor of an alcoholic beverage.

Both men were arrested at the scene as Mullendore told the trooper the liquid was apple pie flavored moonshine.

Mullendore now faces a misdemeanor charge of driving while under the influence of alcohol.

As for Brooke, the two criminal charges against him and a new warrant for his arrest came on Wednesday, April 30.
